Licensing Act 2003 Applications, Hearings and Consultation

Worthing Borough Council is the licensing authority responsible for the administration and enforcement of the Licensing Act 2003. The Licensing Act deals with the sale and supply of alcohol, the provision of regulated entertainment and the sale and supply of late night refreshment. All of which need the authorisation of a premises licence, club premises certificate or temporary event notice.

Alcohol

Under the Act certain functions such as the production of the council's statement of licensing policy together with some types of application require public consultation and, where relevant representation is received, a hearing.

Applications and Policies are advertised in the 'Public Notice & Legal Section' of the local press and/or the Town Hall notice board, on the relevant premises and of course on this website.

Below is a list of the applications under the Licensing Act that are outstanding and other licensing policy documents that the council is currently consulting on or awaiting hearings. 

All the applications and policy documents can be viewed in full at the Licensing Unit. All licensing hearings are held, in public, at the Town Hall unless otherwise noted.

Under the Act minor variation applications cannot be dealt with at hearing but for 

  • New premises licence applications
  • New club premises certificate applications
  • Full variations to existing licences

that receive relevant representations from 'Responsible Authorities' and/or 'Interested Parties', and mediation is unsuccessful or impractical, a hearing is required.

For a review of a premises licence or a club premises certificate a hearing must be held. 

For all applications that require hearings in front of a sub committee or the full committee of Licensing & Control Committee B a detailed report is drafted and published approximately 7 days prior to the hearing. The reports and agendas regarding such applications are published on the Council's Democratic Services web pages together with the minutes of the Licensing hearings.

Quality Food Cash & Carry - Review

An application by a Responsible Authority for the 'Review' of the Premises Licence at: 

'Quality Food Cash & Carry'

The store is situated at 30 Teville Road, Worthing, BN11 1UG. The application is seeking:

  • Revocation of the premises licence,

or at the least

  • Suspension of the licence for a period not exceeding 3 months to act as a deterrent to further criminal activity by the licence holder and similar behaviour by other operators.

The grounds for review being West Sussex Trading Standards Service's contention that the following licensing objectives were being undermined: 

  • the prevention of crime & disorder.
  • public safety

The premises is currently authorised to make sales of alcohol, for consumption off the premises, during the following hours:

  • Monday to Sunday incl. 07.30hrs until 00.00hrs (midnight)

The application was made after a number of alleged incidents involving the sale, or offering for sale, of illegal alcohol to the public from this shop and comes as a result of the subsequent investigations by the Trading Standards Service.

Consultation closed : Tuesday 17 January 2012.

Committee Hearing : Wednesday 15 February 2012 @18.00hrs. 

Due to the nature of this application a hearing will be held by the full Licensing & Control Committee B to consider the review application and the representations recieved from Sussex Police and West Sussex Fire & Rescue Service. 


Express Burgers - New

An application for new premises licence at:  

'Express Burgers' 

The cafe/takeaway is situated at 68 Victoria Road, Worthing, BN11 1UN. The application is seeking authorisation for the sale of alcohol, for consumption off the premises, and the provision of late night refreshment: 

  • Authorisation for the sale of alcohol between: 

 10.00hrs to 00.00hrs (midnight) Sunday to Thursday & 10.00hrs to 01.00hrs, of the following morning, Friday & Saturday.

  • Authorisation for the provision of late night refreshment between: 

     23.00hrs to 00.00hrs (midnight) Sunday to Thursday & 23.00hrs to 01.00hrs, of the following morning, Friday & Saturday.

  • Hours the business is proposing to open to the public:

 10.00hrs to 00.00hrs (midnight) Sunday to Thursday & 10.00hrs to 01.00hrs, of the following morning, Friday & Saturday.

No further licensable activities were proposed by this application.

Applicant : Mr Kajendiran Gopolan

Consultation closed : Tuesday 7 February 2012.

Committee Hearing : Scheduled for Wednesday 7 March 2012 @ 10.00hrs

One representation was received from a responsible authority and six from interested parties. The Licensing Act encourages mediation. This will be embarked on but if unsuccessful a hearing is scheduled as detailed above.


Burlington Hotel - Minor Variation

An application for a minor variation to the premises licence at the:  

'Burlington Hotel' 

The hotel, including night club, bars & restaurant is situated in Marine Parade, Worthing, BN11 3QL. The application is seeking authorisation to amend the following licence condition:

  • The hotel’s CCTV system (consisting of 16 cameras situated internally and externally) is to be maintained in good working order with images recorded being kept in a tamper proof computer system; images to be stored for up to 3 months.  If for any reason the system becomes inoperative/fails, the premises to obtain a stand-in system to cover, as a minimum, all entrances and exits.

To read:

  • The hotel’s CCTV system (consisting of 16 cameras situated internally and externally) is to be maintained in good working order with images recorded being kept in a tamper proof computer system; images to be stored for 28 days.  If for any reason the system becomes inoperative/fails, the premises to obtain a stand-in system to cover, as a minimum, all entrances and exits.

No changes to the hours or types of regulated activity provided were proposed by this application and all other conditions of the licence to remain unchanged

Committee Hearing : Not required for a minor variation

For a minor variation application, in addition to the statutory public consultation, the Licensing Authority has the discretion to consult any responsible authority it considers necessary and relevant to the type of application.

In this case Sussex Police are being consulted.


Madison's Cafe - New

An application for new premises licence at:  

'Madison's Cafe' 

The cafe is situated at 3-5 Royal Arcade, South Street, Worthing, BN11 3AY. The application is seeking authorisation for the sale of alcohol, for consumption on the premises, and the provision of recorded music: 

  • Authorisation for the sale of alcohol between: 

 10.00hrs to 19.30hrs Monday - Thursday & 10.00hrs to 21.30hrs Friday - Sunday.

  • Authorisation for the provision of recorded music between: 

     08.30hrs to 20.00hrs Monday - Thursday & 08.30hrs to 22.00hrs Friday - Sunday.

  • Hours the business is proposing to open to the public:

08.30hrs to 20.00hrs Monday - Thursday & 08.30hrs to 22.00hrs Friday - Sunday.

No further licensable activities were proposed by this application.

Consultation closes : Saturday 18 February 2012.

Committee Hearing : Scheduled for Wedneday 7 March 2012 @ 10.00hrs.


Ashley Supermarket - New

An application for new premises licence at:  

'Ashley Supermarket' 

The convenience store/off licence is situated at 92 Brighton Road, Worthing, BN11 2EN. The application is seeking authorisation for the sale of alcohol, for consumption off the premises: 

  • Authorisation for the sale of alcohol between: 

 06.00hrs to 23.00hrs Monday - Sunday.

  • Hours the business is proposing to open to the public:

06.00hrs to 23.00hrs Monday - Sunday.

No further licensable activities are proposed by this application.
