LA 2003 - Applications completed in 2012

Please find below a list of applications completed since 1 January 2012 by the Licensing Authority, Worthing Borough Council, for new Premises Licences and for Variations to existing Premises Licences.

The terms of the Licensing Act 2003 dictate that all 'new' application and 'variation' applications are publicised and consulted on. If no representations are received from 'Responsible Authorities' or 'Interested Parties' such applications must be granted as applied for. If relevant representations are received and mediation between the parties is unsuccessful then the application has to be deliberated by a sub-committee of the Licensing & Control Committee B following a hearing.

'Minor variations' are also consulted on but only by 'public notice' on the premises, details posted on this website and any responsible authorities the licensing authority selects as relevant. If relevant representations are received and considered by officers to have implications under the licensing objectives then the application is simply rejected and a full variation has to be applied for.


Coast Cafe - Minor Variation

An application for a minor variation to the premises licence at:  

'Coast Cafe'

The cafe is situated at the West Kiosk, Beach Parade, Worthing, BN11 2ES. The application sought authorisation for:

  • Structural alterations to the internal layout.
  • The screening of film on up to six occasions a year during licensed hours. 

No changes to the hours or types of other regulated activity provided were proposed by this application and all the conditions of the licence are to remain unchanged

For a minor variation application, in addition to the statutory public consultation, the Licensing Authority has the discretion to consult any responsible authority it considers necessary and relevant to the type of application.

In this case, as it involved minor structural alterations to the building, that could potentially have crime & disorder and public safety implications, Sussex Police, West Sussex Fire & Rescue Service and the Environmental Health Group were consulted.

No formal representations were received from the public or the authorities consulted. After due consideration by the Licensing Team it was considered that the variation would have no adverse effects on the licensing objectives. Consequently, the variation was granted as per the terms of the Licensing Act 2003.


North Star - Minor Variation

An application for a minor variation to the premises licence at:  

'the North Star'

The public house is situated in Littlehampton Road, Worthing, BN13 1QY. The application sought authorisation for:

  • Minor alterations to the internal layout mainly of a decorative nature. 

No changes to the hours or types of regulated activity provided were proposed by this application and all the conditions of the licence to remain unchanged

The bar & function room is situated on the 3rd Floor of Connaught House, 32-34 Marine Parade, Worthing, BN11 3QA. The application sought authorisation for:

  • Alterations to the internal layout of the function room to install a small bar/servery.

No changes to the hours or types of regulated activity provided were proposed by this application and all the conditions of the licence to remain unchanged

Premier Supermarket Express - Review

An application by a Responsible Authority for the 'Review' of the Premises Licence at: 

'Premier Supermarket Express'

The store is situated at 4-6 South Street, Tarring, Worthing, BN14 7LH. The application sought:

  • Suspension of the licence for a period not exceeding 3 months to act as a deterrent to further criminal activity by the licence holder and similar behaviour by other operators.
  • Imposition of a condition requiring the licence holder to retain for a period of six months all reciepts relating to alcohol stocked and these to be made available for inspection by authorised officers on demand.

The grounds for review being West Sussex Trading Standards Service's contention that the following licensing objectives were undermined: 

  • the prevention of crime & disorder.
  • public safety

The premises is currently authorised to make sales of alcohol, for consumption off the premises, during the following hours:

  • Monday to Saturday from 07.00hrs until 23.00hrs.
  • Sunday from 08.00hrs until 22.00hrs

The application was made after a number of bottles of industrial alcohol falsely labelled as Vodka were discovered being offering for sale to the public from this shop and comes as a result of the subsequent investigations by the Trading Standards Service.

Designated Premises Supervisor : Mr Hassan El Samad.

Consultation closed : Friday 9 March 2012.

Committee Hearing : Held on Monday 23 April 2012.  

Due to the nature of this application a hearing was held by the full Licensing & Control Committee B to consider the review application and the representations recieved from Sussex Police and West Sussex Fire & Rescue Service. 

The Committee heard the submissions of the parties and the licence holder's representatives attended and responded to the representations made. 

The Licensing Act encourages mediation but in this case no mediated solution was reached. 

After considering the representations from all the parties the Committee resolved that the premises licence should be suspended for a period of three months and the following condition was imposed on the licence:

Copies of invoices for current alcoholic stock being sold on the premises, be kept at premises for a period of six months from the date of purchase and be produced to authorised officers on request.

The Committee found that this case was particularly serious. The Committee found that Mr El Samad was irresponsible in this matter in allowing a junior member of staff to purchase alcohol from an unknown source. As a direct result of Mr El Samad’s practices WSCC Trading Standards Service have been unable to trace the source of this alcohol. Mr El Samad has accepted two formal cautions in relation to these matters under the Food Safety Act and the General Food Regulations.

The Committee found that the licensing objectives of crime & disorder and public safety have been seriously undermined. The Committee’s decision was that suspension of the licence for 3 months is necessary and proportionate to act as a deterrent in view of the seriousness of the matter and taking into account the Secretary of State’s Guidance.........  

All parties have 21 days in which to exercise their right of appeal to the Magistrates' court if they consider the decision made unjust. At the end of the appeal period the above will come into force unless an appeal is lodged in which case the above will be suspended until the appeal has been dealt with.


Hartley's - New

An application for new premises licence at:  

'Hartley's' 

The proposed new off-licence is to be situated at 9 Downlands Parade, Upper Brighton Road, Worthing, BN14 9JH. The application sought authorisation for the sale of alcohol for consumption off the premises: 

  • Authorisation for the sale of alcohol between: 

 10.00hrs to 23.00hrs Monday to Sunday incl.

  • Hours the business is proposing to open to the public:

 10.00hrs to 23.00hrs Monday to Sunday incl.

No further licensable activities were proposed by this application.

Applicant : M & O Trading Ltd.

Consultation closed : Wednesday 4 April 2012.

Committee Hearing : Cancelled.

No representations were received from 'interested parties', local residents, or from the 'responsible authorities' regarding this application.  

Consequently, the application was approved as applied for as per the terms of the Licensing Act 2003.


Co-Op, Broadwater Road - Variation

An application for a variation to the premises licence at the:  

'Co-Operative' 

The store is situated at 66 Broadwater Road, Worthing, BN14 8AG. 

The sale of alcohol was authorised from this store from 08.00hrs to 23.00hrs Monday to Saturday and 10.30hrs to 22.30hrs on Sunday. The application sought authorisation to extend:

  • The hours for the sale of alcohol to between:

06.00hrs to 23.00hrs Monday to Sunday incl. 

  • The hours that the business to open to the public:

06.00hrs to 23.00hrs Monday to Sunday incl.

No changes to the current conditions of licence were proposed by this application but the applicant did volunteer a number of conditions including CCTV, extra store security and a 'Challenge 25' policy to the licence if the variation application were approved.

Consultation closed : Wednesday 28 March 2012.

Committee Hearing : Cancelled.

No representations were received from 'interested parties', local residents, but one representation was received regarding this application from Sussex Police. 

The Licensing Act encourages mediation and as a result the Co-Op agreed to address the Police's concerns and volunteered a number of conditions to the licence, regarding crime & disorder and the protection of children from harm, that will be legally enforceable. As a result Sussex Police's representation was withdrawn. 

Consequently the amended application was approved as per the terms of the Licensing Act 2003.


Co-Op, Field Place Parade - Variation

An application for a variation to the premises licence at the:  

'Co-Operative' 

The store is situated at 3-6 Field Place Parade, Worthing, BN12 6BS. 

The sale of alcohol was authorised from this store from 08.00hrs to 23.00hrs Monday to Saturday and 10.30hrs to 22.30hrs on Sunday. The application sought authorisation to extend:

  • The hours for the sale of alcohol to between:

06.00hrs to 23.00hrs Monday to Sunday incl. 

  • The hours that the business is to open to the public:

06.00hrs to 23.00hrs Monday to Sunday incl.

An application for a minor variation to the premises licence at:  

'Your Local' 

The shop is situated at 74 Goring Road, Worthing, BN12 4AF and until recently was known as '74 Convenience Store'. The application sought authorisation for:

  • Alterations to the internal layout of the store.

No changes to the hours or types of regulated activity provided are proposed by this application and all the conditions of the licence are to remain unchanged

An application by a Responsible Authority for the 'Review' of the Premises Licence at: 

'Best One'

The store is situated at 5 Coronation Buildings, Ham Road, Worthing, BN11 2NN. The application sought:

  • Suspension of the licence for a period not exceeding 3 months to act as a deterrent to further criminal activity by the licence holder and similar behaviour by other operators.
  • Imposition of a condition requiring the licence holder to retain for a period of six months all reciepts relating to alcohol stocked and these to be made available for inspection by authorised officers on demand.

The grounds for review being West Sussex Trading Standards Service's contention that the following licensing objectives were being undermined: 

  • the prevention of crime & disorder.
  • public safety

The premises is currently authorised to make sales of alcohol, for consumption off the premises, during the following hours:

  • Monday to Saturday from 08.00hrs until 23.00hrs.
  • Sunday from 10.00hrs until 22.30hrs

The application was made after two alleged incidents involving the sale, or offering for sale, of illegal alcohol to the public from this shop and comes as a result of the subsequent investigations by the Trading Standards Service.

Consultation closed : Thursday 8 March 2012.

Committee Hearing : Thursday 29 March 2012. 

Due to the nature of this application a hearing was held by the full Licensing & Control Committee B to consider the review application and the representation recieved from Sussex Police. 

The Committee heard the submissions of the parties and the licence holder, Mr Manickarajah Ranjith, attended and responded to the representations made. 

The Licensing Act encourages mediation but in this case no mediated solution was reached. 

The Committee resolved that the premises licence should be suspended for a period of two months and the following condition was imposed on the licence:

Copies of invoices for current alcoholic stock being sold on the premises, be kept at premises for a period of six months from the date of purchase and be produced to authorised officers on request.

The Committee considered this case particularly serious. The Committee found that the licence holder was totally irresponsible in this matter and as a direct result trading standards have been unable to trace this illegal alcohol. The licence holder was unaware whether or not this alcohol was harmful to a person’s health.

The Committee found that the licensing objectives of crime & disorder and public safety have been seriously undermined. The Committee’s decision was that suspension of the licence for 2 months is necessary and proportionate to act as a deterrent in view of the seriousness of the matter and taking into account the Secretary of State’s Guidance.........  

All parties have 21 days in which to exercise their right of appeal to the Magistrates' court if they consider the decision made unjust. At the end of the appeal period the above will come into force unless an appeal is lodged in which case the above will be suspended until the appeal has been dealt with. 


Ashley Supermarket - New

An application for new premises licence at:  

'Ashley Supermarket' 

The convenience store/off licence is situated at 92 Brighton Road, Worthing, BN11 2EN. The application sought authorisation for the sale of alcohol, for consumption off the premises: 

  • Authorisation for the sale of alcohol between: 

 06.00hrs to 23.00hrs Monday - Sunday.

  • Hours the business is proposing to open to the public:

06.00hrs to 23.00hrs Monday - Sunday.

No further licensable activities were proposed by this application.

Applicants : Mr Rajalingam Patheepan & Mr Sivapathasunderam Rajeeve.

Committee Hearing : Cancelled

Two representations were received regarding this application from Responsible Authorities. Namely Sussex Police and West Sussex Fire & Rescue Service. None from interested parties.

The Licensing Act encourages mediation. During the course of mediation the applicant addressed the Responsible Authorities' concerns. Amending the application to reduce the hours proposed, starting alcohol sales at 08.00hrs instead of 06.00hrs, volunteering a number of conditions that will become legally binding and agreeing to complete works required for fire regulations. As a result the authorities withdrew their representations.

Consequently the amended application was approved as per the terms of the Licensing Act 2003.


Gala Club Bingo - Minor Variation

An application for a minor variation to the premises licence at:  

'Gala Club Bingo - The Plaza' 

The club is situated in Rowlands Road, Worthing, BN11 3JS. The application sought authorisation for:

  • Minor alterations to the layout of the ground floor area which houses the amusement with prizes machines.

No changes to the hours or types of regulated activity provided were proposed by this application and all other conditions of the licence to remain unchanged

An application for new premises licence at:  

'Express Burgers' 

The cafe/takeaway is situated at 68 Victoria Road, Worthing, BN11 1UN. The application sought authorisation for the sale of alcohol, for consumption off the premises, and the provision of late night refreshment. Both activities to be authorised for visitors to the premises and by home delivery: 

  • Authorisation for the sale of alcohol between: 

 10.00hrs to 00.00hrs (midnight) Sunday to Thursday & 10.00hrs to 01.00hrs, of the following morning, Friday & Saturday.

  • Authorisation for the provision of late night refreshment between: 

     23.00hrs to 00.00hrs (midnight) Sunday to Thursday & 23.00hrs to 01.00hrs, of the following morning, Friday & Saturday.

  • Hours the business is proposing to open to the public:

 10.00hrs to 00.00hrs (midnight) Sunday to Thursday & 10.00hrs to 01.00hrs, of the following morning, Friday & Saturday. 

No further licensable activities were proposed by this application. The application confirmed that authorisation for the sale of alcohol was being sought only to persons purchasing food. Whether personally present in the shop or ordering for delivery.

Applicant : Mr Kajendiran Gopolan

Consultation closed : Tuesday 7 February 2012.

Committee Hearing : Held on Wednesday 7 March 2012

Representation was recieved from two Responsible Authorities, Sussex Police and West Sussex Fire & Rescue Service; and 6 Interested Parties, neighbours. The Licensing Act encourages mediation and after discussions with Sussex Police, the applicant volunteered a number of conditions to address the Police concerns and as a result they withdrew their objection.

However, the representation of the Fire & Rescue Service and 6 representations recieved from neighbours were not addressed and therefore a hearing in front of a Licensing & Control sub-committee was held. 

During the hearing the applicant gave an assurance to members that if the licence were granted all issues detailed in the fire report would be addressed before any licensable activities were commenced.

The Sub Committee considered all the written representations and verbal submissions and the amendments offered by the applicant to address the Responsible Authorities' concerns. 

After due consideration members resolved to grant a licence in the terms applied for but including the amendments volunteered during mediation and at the hearing. These amendments to become enforceable conditions of the premises licence.


Madison's Cafe - New

An application for new premises licence at:  

'Madison's Cafe' 

The cafe is situated at 3-5 Royal Arcade, South Street, Worthing, BN11 3AY. The application is sought authorisation for the sale of alcohol, for consumption on the premises, and the provision of recorded music: 

  • Authorisation for the sale of alcohol between: 

 10.00hrs to 19.30hrs Monday - Thursday & 10.00hrs to 21.30hrs Friday - Sunday.

  • Authorisation for the provision of recorded music between: 

     08.30hrs to 20.00hrs Monday - Thursday & 08.30hrs to 22.00hrs Friday - Sunday.

  • Hours the business is proposing to open to the public:

08.30hrs to 20.00hrs Monday - Thursday & 08.30hrs to 22.00hrs Friday - Sunday.

No further licensable activities were proposed by this application.

Applicant : Mrs Alexandra Murphy.

Consultation closed : Saturday 18 February 2012.

Committee Hearing : Cancelled.

Three representations were received regarding this application from Responsible Authorities. None from interested parties.

The Licensing Act encourages mediation. During the course of mediation the applicant addressed the Responsible Authorities' concerns. Amending the application to remove permission for the provision of recorded music and volunteering a number of conditions that will become legally binding. As a result the authorities withdrew their representations.

Consequently the amended application was approved as per the terms of the Licensing Act 2003.


Spy Glass - Minor Variation

An application for a minor variation to the premises licence at:  

'Spy Glass' 

The restaurant/bar is situated at 31a Marine Parade, Worthing, BN11 3PU. The application sought authorisation to:

  • Carry out a minor structural alteration. Altering the internal layout of the bar to create a small beer cellar between the bar and kitchen.

No changes to the hours for licensable activity or types of regulated activity provided were proposed by this application. All conditions of the licence to remain unchanged

Burlington Hotel - Minor Variation

An application for a minor variation to the premises licence at the:  

'Burlington Hotel' 

The hotel, including night club, bars & restaurant is situated in Marine Parade, Worthing, BN11 3QL. The application sought authorisation to amend the following licence condition:

  • The hotel’s CCTV system (consisting of 16 cameras situated internally and externally) is to be maintained in good working order with images recorded being kept in a tamper proof computer system; images to be stored for up to 3 months.  If for any reason the system becomes inoperative/fails, the premises to obtain a stand-in system to cover, as a minimum, all entrances and exits.

To read:

For a minor variation application, in addition to the statutory public consultation, the Licensing Authority has the discretion to consult any responsible authority it considers necessary and relevant to the type of application.

In this case Sussex Police were consulted.

Initially Sussex Police expressed a concern regarding the supply of images for investigation purposes but the applicant addressed these during mediation. No formal representations were received from interested parties or the authorities consulted. After due consideration by the Licensing Team it was considered that the variation would have no adverse effects on the licensing objectives.

Consequently, the variation was granted as per the terms of the Licensing Act 2003.


Quality Food Cash & Carry - Review

An application by a Responsible Authority for the 'Review' of the Premises Licence at: 

'Quality Food Cash & Carry'

The store is situated at 30 Teville Road, Worthing, BN11 1UG. The application sought:

  • Revocation of the premises licence,

or at the least

  • Suspension of the licence for a period not exceeding 3 months to act as a deterrent to further criminal activity by the licence holder and similar behaviour by other operators.

The grounds for review being West Sussex Trading Standards Service's contention that the following licensing objectives were being undermined: 

  • the prevention of crime & disorder.
  • public safety

The premises is currently authorised to make sales of alcohol, for consumption off the premises, during the following hours:

  • Monday to Sunday incl. 07.30hrs until 00.00hrs (midnight)

The application was made after a number of alleged incidents involving the sale, or offering for sale, of illegal alcohol to the public from this shop and comes as a result of the subsequent investigations by the Trading Standards Service.

Committee Hearing : Held on Wednesday 15 February 2012. 

Due to the nature of this application a hearing was held by the full Licensing & Control Committee B to consider the review application and the representations recieved from Sussex Police and West Sussex Fire & Rescue Service. 

The Committee heard the submissions of the parties and the licence holder, Mr Khaver Shahzad, attended and responded to the representations made. 

The Licensing Act encourages mediation.

The Committee resolved that the application to revoke the premises licence be set aside following successful mediation between all the parties. 

Instead a number of measures, agreed by the parties, were imposed on the licence:

  • The premises licence should be suspended for a period of three months. During which time there is to be no sale of alcohol and the shelves are to be cleared.
  • On reinstatement of the licence the store to cease the sale of alcohol at 23.00 hrs every day instead of at midnight.
  • The premises to close for business at 23:00 hours every day.
  • The DPS be removed and a variation to specify a new DPS to be submitted. This DPS should be acceptable to Sussex Police.
  • A full Fire Risk Assessment to be carried out by a competent person and all reasonable requirements of the West Sussex Fire Authority Enforcement Notice be complied with, and evidence supplied to the Fire Authority for signing off, before being permitted to re-open to trade under the authority of the premises licence.
  • A clear new formal management structure to be established in writing. The Management Policy operated at the premises must be readily available to all staff working at the premises and produced for inspection at the request of Police or an Authorised Officer of the Local Authority or Fire Authority which records as a minimum, a number of responsibilities regarding the purchase & sale of alcohol, the keeping and production of suppliers details, staff training and management responsibility. These to become enforceable conditions of licence.

The Committee found that the licensing objectives ‘the prevention of crime and disorder’ and ‘public safety’ had been undermined. However, the conditions agreed during mediation and recommended by the applicant were accepted by the Committee. The Committee believed these were proportionate and would:

  • Act as a deterrent to further criminal activity by this licence holder and other operators.
  • Allow the necessary works to be carried out on the store.
  • Allow the new management structure to be put in place.
  • Give a suitable period so that staff & management training could be undertaken to promote the licensing objectives of crime and disorder and public safety.

In reaching their decision members had due regard to the Home Office guidance, the Council’s own Licensing Policy, relevant licensing legislation, representations made by responsible authorities, the applicant and licence holder. They have also had regard to Human Rights legislation and the rules of natural justice. 

The Licensing Committee gave due consideration to all representation made including those submitted in writing, and considered all issues raised giving particularly regard to those relating to crime & disorder and public safety.

All parties have 21 days in which to exercise their right of appeal to the Magistrates' court if they consider the decision made unjust. At the end of the appeal period the above will come into force unless an appeal is lodged in which case the above will be suspended until the appeal has been dealt with. 


Booker Cash & Carry - Minor Variation

An application for a minor variation to the premises licence at:  

'Booker Cash & Carry' 

The wholesale unit is situated in Southdown View Road, Broadwater Trading Estate, Worthing, BN14 8NT. The application sought authorisation for:

  •  Minor alterations to the layout of the store/warehouse.

No changes to the hours or types of regulated activity provided were proposed by this application and all other conditions of the licence to remain unchanged

Licenceholder & Applicant : Booker Ltd.

Committee Hearing : Not required for a minor variation

No formal representations were received from interested parties or the authorities consulted. After due consideration by the Licensing Team it was considered that the variation would have no adverse effects on the licensing objectives. Consequently, the variation was granted as per the terms of the Licensing Act 2003.


Tesco, Goring Road - New

An application for a new premises licence at:  

                                                                           'Tesco' 

The new store is to be situated at 24 - 26 Goring Road, Worthing, BN12 4AJ. The application sought: 

  • Authorisation for the sale of alcohol for consumption off the premises between: 

 06.00hrs to 23.00hrs Monday to Sunday incl.

  • Hours the business is proposing to open to the public:

 06.00hrs to 23.00hrs Monday to Sunday incl.

No further licensable activities were proposed by this application.

Applicant : Tesco Stores Ltd.

Consultation closed : Sunday 8 January 2011

Committee Hearing : Cancelled

No representations were received from 'interested parties', local residents, but one representation was received regarding this application from West Sussex Fire & Rescue Service. 

The Licensing Act encourages mediation and as a result Tesco agreed to address the Fire & Rescue Service's concerns.  

Consequently the amended application was approved as per the terms of the Licensing Act 2003.
