Sex Establishment Licensing - Applications completed.

Please find below a list of applications made since 1 January 2009 to the Licensing Authority, Worthing Borough Council, for new Sex Establishment Licences and for Variations to existing Licences.

The terms of the Local Government (Miscellaneous Provisions) Act 1982 dictates that all such applications are publicised and consulted on. Furthermore, the council notifies in writing all households and businesses within a 50m radius of the premises. All relevant representation received regarding such applications is considered and deliberated by the Licensing & Control Committee following a public hearing.


Taboo - Application

  •  Taboo, 101 Rowlands Road, BN11 3JX

An application for a new Sex Shop Licence authorising the sale of R18 films (inc.DVDs & Videos) and the carrying on of a business that 'consists to a significant degree of selling, hiring, exchanging, lending, displaying or demonstrating sex articles or other things intended for use in connection with, or for the purpose of stimulating or encouraging sexual activity or acts of force or restraint which are associated with sexual activity'. 

The use of premises for the purposes of a sex shop is subject to legislative controls contained in Schedule 3 of the Local Government (Miscellaneous Provisions) Act 1982 (LGMPA). 

This particular premises has operated in the past as a licensed sex shop under the name 'Pillow Talk' between 1 July 2009 and November 2010 and as an unlicensed 'adult' shop under the name of 'Secret Desires' before that, since 2005.

In November 2010 the licence holder, Mr A Butler, surrendered the licence as he was no longer involved in the business.

The premises has continued to operate up to date as an unlicensed adult shop. The effect of being unlicensed meant no R18 rated video/DVD films and only a limited proportion of sex articles were offered for sale.

The new owners of the business applied on 25 February 2011 to re-licence the shop.

Committee Hearing : Not required

Only one written representation was received regarding this application from a member of the public. However, this objected to the sale of R18 films in general and was not specific regarding this premise or application and could not be considered relevant.

Two representations were received from responsible authorities (inc. Sussex Police) but neither objected to this application. 

As no relevant representation was received a hearing by the Licensing & Control Committee to consider the application was deemed unnecessary.

The licence was granted for a period of 12 months subject to a number of conditions in addition to the 'standard' mandatory conditions including : 

  • Limiting the hours the premises could open for business.
  • CCTV provision and image storage. 
  • Conditions effecting signage and window display.
  • Staff vetting.

An application for a new Sex Shop Licence authorising the sale of R18 films (inc.DVDs & Videos) and the carrying on of a business that 'consists to a significant degree of selling, hiring, exchanging, lending, displaying or demonstrating sex articles or other things intended for use in connection with, or for the purpose of stimulating or encouraging sexual activity or acts of force or restraint which are associated with sexual activity'. 

The use of premises for the purposes of a sex shop is subject to legislative controls contained in Schedule 3 of the Local Government (Miscellaneous Provisions) Act 1982 (LGMPA). 

This particular premises had been open and been operated as an unlicensed 'adult' shop under the name of 'Secret Desires' since 2005 but under different ownership. The effect of being unlicensed meant the business in the past was unable to sell R18 rated video/DVD films and only a limited proportion of sex articles. However, being unlicensed has also meant the business was able to allow entry to patrons under the age of 18 and no controls regarding what could be displayed in this shop’s windows could be placed on the premises by the Licensing Authority.

Committee Hearing : Was held on Wednesday 1 July @ 18.00hrs. 

Sixty nine written representations were received regarding this application from members of the public. One from a responsible authority, Sussex Police, who supported the application. A hearing by the Licensing & Control Committee considered the application.
