Street trading means the selling, or exposing, or the offering for sale, of any article (including a living thing) in a street. A street for the purposes of this definition, includes any road, highway, footway, beach or other area to which the public have free access without payment.
Worthing Borough Council has a strict policy governing street trading. Complaints regarding the conduct of some street traders in the past has led the council to adopt controls in many areas of the borough under the provisions of Schedule 4 of the Local Government (Miscellaneous Provisions) Act 1982. Many sections of the town have been designated 'prohibited' or 'consent' streets allowing the council to control the proliferation of such traders.
Under the Act for the council to adopt controls in an area the proposal (or resolution) requires the consultation of the police, highways authority and the public. Where relevant representation is received, the council must consider the representation before deciding whether to go ahead.

On the 11 November 2009 Worthing Borough Council's Licensing & Control Committee A considered a report regarding the recent increase in the number of cars for sale on the highway at a number of sites within the Borough and the consequent increase in resident complaint. Members were requested to deliberate whether measures to control the practice were required and a number of options were considered.
The Committee made the recommendation that the Council consult on adopting street trading controls in a number of designated main roads. In accordance with the act, a notice of intention to pass a resolution designating a number of streets ,or areas, as ‘prohibited streets’ for the purposes of street trading, was published.
Consultation on this matter closed on 14 January 2010. A number of representations were received. The council's Licensing & Control Committee considered these at its meeting on 2 March 2010. As a result the council has designated the following streets as prohibited streets for the purposes of street trading:
The designation to come into effect on 1 May 2010. As from that day Street Trading in any of the above streets is prohibited and to sell or offer for sale any goods, including cars, is an offence (punishable with a fine of up to £1,000 for each separate offence).
