 Personal Search requests under the new regime of EIR as from 2 August 2010

You are entitled to carry out Personal Searches of Environmental Information under the EI Regulations free of charge with effect from Monday 2 August 2010.  Although we are only obliged to allow inspection of public registers we recognise that this would be inefficient for both yourself and the local authority staff.  Accordingly, we propose to implement the following system when a personal search is requested. 

  • You will need to continue to submit your requests in writing as previously.  We will deal with them on a first come, first served basis
  • You will need to include your name, address, telephone number and email address in your request
  • There will no longer be an appointment system for the collection of personal search results
  • We will send you reports showing basic information from the Local Land Charges Register
  • Adur EIR Requests: Please send your information requests to landcharges@adur-worthing.gov.uk AND the Planning Section AdurEIRRequests@adur-worthing.gov.uk. Responses will be sent back individually from the two sections
  • Worthing EIR Requests: Please send your information requests to landcharges@adur-worthing.gov.uk

Official search of the Local Land Charges Register (LLC1)

Should you require a compiled report of information contained on the Local Land Charges Register, rather than a Personal Search made under the EI Regulations, please either send in an LLC1 form for which a payment of £12 is required for postal, or use our Online Form or email your LLC1 request for which a payment of £10 is required, to the Local Land Charges Section for Adur and Worthing at:

The Local Land Charges Register only includes planning permissions that have been approved with conditions from 1 August 1977 (Rule 7 of the Local Land Charges Rules 1977). The Local Land Charges Register also includes entries such as Listed Buildings, Conservation Areas, Tree Preservation Orders etc.

Reference may also be made to the Planning Register for full planning history.  Other public registers maintained by the Authority may also be inspected, however, these do not form an integral part of the personal search process. 

An EIR request will not procure answers to the enquiries on the CON29R form from the Local Land Charges Section.  Such enquiries can only be answered by the Local Land Charges Section in the context of a full search, which will require the submission of the correct forms, correct fee and plan (if necessary).

Listed below are some other Council statutory registers open for public inspection during reasonable office hours (An appointment may be necessary and a charge levied for the provision of any additional information.) These do not form part of the personal search.

From 6th October 2006, an on-line search will be available giving the Con29 highway replies for the cost of £15 per search, for this please visit www2.westsussex.gov.uk/landcharges. This does not include extent of adopted highway. Please contact Local Land Charges at WSCC on 01243 777190 for further information, and to set up an account with them.
