Technical Guidance Note 3 : Regularisation Application Procedure

Introduction

It is possible that the building you own, or are considering purchasing has had building work carried out to it.  This work may have required the benefit of a Building Regulation application.  If no approval was given for the work, an application for a Regularisation certificate may be submitted in order to rectify the matter.Who May Apply?The owner of the building containing the unauthorised work may apply to the Council for a Regularisation Certificate, providing that:

     
  1. The unauthorised work was commenced on, or after the 11 November 1985, and
       
       
  2. A Building Notice, or Full Plans application was not given to the local authority, or
       
       
  3. Notice of commencement was not given to the local authority for a Building Notice or Full Plans application that had been made.

Applications

A regularisation application must be accompanied by the following information:

     
  • A description of the unauthorised work,
       
       
  • A plan of the unauthorised work,
       
       
  • A plan showing any additional work required to comply with the Building Regulations in force when the unauthorised work was carried out, and
       
       
  • A fee (see Guidance Note on fees).
Application Procedure 
     
  1. Confirm that the building work is unauthorised, and that you wish to regularise the work.
       
       
  2. Discuss with the Building Control Officer, and possibly arrange a site inspection to assess whether a regularisation application is suitable.
       
       
  3. Deposit a regularisation application, including all necessary information, as detailed above.
       
       
  4. The Building Control group will examine the application and assess what works, if any, need to be exposed for inspection, or need to be carried out to secure compliance with the Building Regulations.  This may involve further site inspections.
       
       
  5. The Council will notify you of:
       
       
           
    • The work required to ensure compliance with the Building Regulations
             
                 
    • The fact that no work is necessary to comply with the Building Regulations, or
             
                 
    • That they cannot determine what work is required to comply with the Building Regulations.   
       
       
  6. Once any remedial work has been satisfactorily carried out a Regularisation Certificate may be issued.  If the situation arises that the Council cannot determine what works are necessary to comply with the Building Regulations, further discussions must take place between the owner and the Building Control Officer.
Inspections 

Inspections may be arranged by telephone during normal office hours.  To ensure that an inspection can be made at the preferred time, it is desirable that 24 hours notice is given.
