Planning Enforcement

Introduction

We frequently receive complaints regarding development which may be proceeding without the necessary planning consent.

If development is carried out without the appropriate planning permission or consent the Development Control Group will try to negotiate sympathetically to resolve the matter. This may result in the submission of a retrospective planning application seeking to either continue a particular use or retain an extension or structure.

However, if the development is causing harm then we can, where it is appropriate, take enforcement action to remedy breaches of planning control. To do something without planning permission is not illegal, i.e., not a criminal offence. However, unauthorized works to listed buildings, unauthorized works to preserved trees or the display of advertisements without consent are offences and, where appropriate, we can prosecute offenders.

Making a Planning Enforcement Complaint

If you wish to make a complaint regarding alleged breaches of planning control, you can either contact Planning in person, via e-mail, post or in person using our contact details:

Alternatively we recommend you use our on-line reporting form:

Setting Ourselves Standards

We have an adopted Code of Practice for the Enforcement of Planning Controls, a copy of which is also available on request at our Reception Desk. This sets targets for the Council to meet.
