Planning and Compulsory Purchase Act 2004 – Saving Local Plan Policies

Schedule 8 of the Planning and Compulsory Purchase Act 2004 specified a period in which transitional arrangements would be set up to avoid a policy vacuum during the preparation of emerging Local Development Framework documents, primarily the Core Strategy, which will be the planning document that sets out Worthing’s key issues and options for future planning in the town, providing a strategic framework that will guide development within the Borough.

The Act made provision for existing planning policies in Local Plans to remain in force for 3 years, following the commencement order in the Act. The three year period from the commencement order for the Act elapsed on 27th September 2007 and from this date the Worthing Local Plan 2003 will no longer function in its entirety. The Secretary of State for Communities and Local Government (DCLG) made a direction to allow Local Authorities to save specific policies after this date.

In August 2006, DCLG released a protocol for handling proposals to save Local Plan policies beyond the ‘saved period’.  If Local Authorities wished to retain specified policies beyond the expiry of the 3 year period, they were required to seek the Secretary of State’s agreement to issue a direction to save them by 1 April 2007. The DCLG outlined key criteria against which any saved policies would need to comply.

In summary the Government would not allow the Council to ‘save’ policies if they are out of date; they repeat national guidance; are adequately covered by other policies in the Local Plan or emerging policies of LDF documents or; they do not technically cover a planning matter. A detailed assessment of each Local Plan policy against the key criteria has been carried out and a list of saved policies was forwarded to the Government Office for the South East (GOSE) for consideration and approval.

Confirmation of the policies that were to be saved and retained was received from GOSE on 25th September.
